Terms and Conditions

For courses, downloadable materials and tutor training purchased through holomathesis.co.uk.

1. Who we are and how these terms apply

1.1 These Terms and Conditions ("Terms") apply to the website, courses, downloadable materials, adult training and associated services supplied through holomathesis.co.uk (together, the "Service") by Holomathesis, ("Holomathesis", "we", "us" or "our").

1.2 By creating an account, placing an order or using purchased materials, you agree to these Terms. You must not place an order if you do not agree to them.

1.3 You must be aged 18 or over to create an account, purchase anything, enter into a contract with us or communicate with us about a course or learner.

1.4 Where materials are used with a learner under 18, you confirm that you are their parent or legal guardian, or a tutor authorised by their parent or legal guardian. You are responsible for that use and for deciding whether the material is suitable.

1.5 If we reasonably believe that a purchaser or account holder is under 18, we may suspend access, cancel and refund the order, close the account and remove information that we are not legally required to retain.

2. The Holomathesis method and age range

2.1 Holomathesis is a learning method for learners aged five and over. This does not mean that every course or resource is suitable for every learner aged five and over.

2.2 Each learner course or resource will state its intended age, educational stage, prerequisites and whether it is adult-led, adult-supported or suitable for an adult learner to use independently.

2.3 Materials for anyone under 18 must be selected, purchased and managed by an adult. Materials for younger learners are intended to be delivered by a parent, legal guardian or authorised tutor.

2.4 The Service is not a school, childcare service, examination body, tutoring marketplace, diagnostic service or regulated education provider. We do not introduce, recommend, employ or supervise tutors and are not a party to arrangements between families and tutors.

3. Child accounts, information and communication

3.1 We do not provide accounts, profiles, logins, mailing-list subscriptions, direct messaging or customer-support services to anyone under 18.

3.2 Adults must not enter a child's name, contact details, date of birth, school, work, assessment results, health information, safeguarding information or other identifiable information into account, checkout, contact or support fields.

3.3 Course activities completed by a child are to remain between the learner and the adult supporting them. They must not be uploaded or sent to us.

3.4 Our separate Privacy Notice explains what information we collect from adult visitors and customers, why we use it and how long we retain it.

4. Artificial intelligence

4.1 No child is given direct access to an artificial intelligence system, chatbot or personalised AI feature as part of the Service.

4.2 AI may assist us internally with research, drafting, editing or quality assurance. Human review remains responsible for published teaching content, claims, examples and age suitability.

4.3 If an adult independently chooses to use an external AI product while preparing or delivering a lesson, that use is outside the Service. The adult must comply with that provider's terms and must not enter identifiable or confidential learner information.

5. Educational limits and adult responsibility

5.1 Holomathesis does not diagnose learning differences and does not replace a teacher, SEN professional, educational psychologist, medical professional, counsellor, safeguarding professional or other appropriately qualified adviser.

5.2 We do not promise any particular grade, qualification, level of confidence, memory improvement, wellbeing outcome or educational result.

5.3 The responsible adult must assess suitability, supervise use, adapt activities where appropriate and stop using material that appears unsuitable or distressing. Appropriate professional advice should be sought where necessary.

5.4 Parents and legal guardians remain responsible for safeguarding and for checking the identity, suitability, references and current DBS status of any tutor they engage. Completing a Holomathesis course does not constitute our approval, accreditation or continuing supervision of that tutor.

6. Orders, accounts and payment

6.1 Product pages show the price, currency, included files, access period, intended audience and licence before purchase. Prices include VAT where we are legally required to include it.

6.2 You must provide accurate adult purchaser and payment information. You are responsible for keeping account credentials secure and must tell us promptly about suspected unauthorised use.

6.3 An order is accepted when we send an order confirmation. We may reject or cancel an order where payment fails, pricing is clearly erroneous, the product is unavailable, fraud is suspected or the adult-purchaser requirement has not been met.

7. Digital content, cancellation and refunds

7.1 Digital content is normally supplied immediately after payment. Before immediate supply, checkout will ask for your express consent to receive the content during the 14-day cancellation period and your acknowledgement that your cancellation right will be lost once downloading or access begins.

7.2 If you do not give that express consent and acknowledgement, we may delay supplying the digital content until the 14-day cancellation period has ended.

7.3 Once supply has begun following your express consent and acknowledgement, you lose the statutory right to cancel simply because you have changed your mind.

7.4 Nothing in these Terms affects your statutory rights. Where digital content is faulty, not as described or does not otherwise conform to the Consumer Rights Act 2015, the remedies required by law remain available.

7.5 Refund or cancellation requests should be sent to [support email], quoting the adult purchaser's name and order number. We will not ask for information about a child to process the request.

8. Licences and permitted use

8.1 Holomathesis and all course text, videos, audio, diagrams, exercises, templates and downloads are owned by us or used under licence and are protected by intellectual-property law.

8.2 The product page and order confirmation identify the licence purchased:

• Individual or family licence: use by the adult purchaser and, where stated, learners in their immediate family.
• Tutor licence: use by the named adult tutor with learners they are directly engaged and authorised to teach, subject to any learner, site or time limit shown with the product.
• Organisation licence: use only by the named organisation and authorised personnel within the limits stated in its order.

8.3 You must not resell, redistribute, publicly upload, share account access, remove rights notices, create a competing course from the materials or use an individual or family licence for paid tutoring.

8.4 Editable resources may be adapted for permitted use, but adapted versions remain subject to the purchased licence and must not be sold or publicly distributed.

9. Availability and changes

9.1 We may correct errors and make reasonable improvements to content. Material changes to a purchased product will not remove the core content or access already promised without an appropriate remedy.

9.2 We do not guarantee uninterrupted availability of the website. Planned maintenance, security events and circumstances outside our reasonable control may temporarily affect access.

10. Liability

10.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or anything else that cannot legally be excluded or limited.

10.2 Subject to section 10.1, we are not responsible for educational decisions made by an adult, outcomes that were not expressly promised, misuse of materials, external services, or the acts or omissions of independently engaged tutors.

10.3 If you are acting in the course of a business and not as a consumer, our total liability arising from the Service will not exceed the amount paid for the product giving rise to the claim. This cap does not apply where section 10.1 prevents it.

11. Acceptable use

11.1 You must not attempt to bypass payment or access controls, compromise the website, use materials unlawfully, impersonate another person, submit malicious code or use the Service in a way that infringes another person's rights.

11.2 We may suspend access where reasonably necessary to investigate misuse, protect users or systems, comply with law or enforce these Terms.

12. Changes to these Terms

12.1 The version accepted at checkout governs that purchase. We may update these Terms for future purchases or continued services, but we will not retrospectively remove rights already attached to a completed purchase.

13. Governing law

13.1 These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you retain any mandatory protections and rights to bring proceedings that the law of your home jurisdiction gives you.

14. General provisions

14.1 If part of these Terms is found unenforceable, the remaining provisions continue to apply.

14.2 A delay in enforcing a right is not a waiver of that right.

14.3 No person other than you and us has a right to enforce these Terms, except where applicable law provides otherwise.
